1. Use of Our Services

By placing an order, you confirm that you are at least 18 years old or have permission from a parent or legal guardian. You agree to use our services only for lawful purposes.

2. Custom Products & Order Accuracy

All products offered by Memory Merch are custom-made using the images and information you provide. It is your responsibility to ensure that all uploaded photos, cropping selections, and order details are accurate before completing your purchase.

Memory Merch is not responsible for issues resulting from low-resolution images, improper cropping, or user-submitted errors.

3. User Content & Image Uploads

By uploading images to our website, you represent and warrant that:

  • You own the rights to the images or have permission to use them

  • The images do not infringe on any copyrights, trademarks, or other rights

  • The images do not contain unlawful, offensive, or prohibited content

You grant Memory Merch a limited, non-exclusive license to use your uploaded images solely for the purpose of fulfilling your order.

4. Prohibited Content

We reserve the right to refuse or cancel any order that includes content we deem inappropriate, including but not limited to:

  • Copyrighted material without permission

  • Explicit, illegal, or offensive content

  • Content that violates the rights of others

5. Order Acceptance & Cancellation

We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, policy violations, or operational limitations.

6. Pricing & Payment

All prices are listed in U.S. dollars. Payment is required at the time of purchase. We reserve the right to update pricing at any time without prior notice.

7. Shipping & Delivery

Shipping times are estimates and not guaranteed. Memory Merch is not responsible for delays caused by carriers or circumstances beyond our control. Please add 2-3 days to ship time to account for the product to be actually made per your specific order.

8. Returns & Refunds

Due to the custom nature of our products, all sales are generally final. If there is an issue with your order, please contact us and we will work to resolve it.

9. Image Storage & Deletion

Uploaded images may be temporarily stored for the purpose of order fulfillment and customer support. Memory Merch does not guarantee long-term storage of your images and reserves the right to delete them at any time after order completion.

We recommend keeping your own copies of all uploaded files.

10. Limitation of Liability

To the fullest extent permitted by law, Memory Merch shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services.

Our total liability shall not exceed the amount paid for the product in question.

11. Indemnification / Hold Harmless

You agree to indemnify, defend, and hold harmless Memory Merch and its owners, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your use of our services

  • Your uploaded content

  • Any violation of these Terms

12. Intellectual Property

All website content, branding, and materials are the property of Memory Merch and may not be used or reproduced without permission.

Gift Card Terms & Conditions

No Expiration
Our gift cards do not expire and have no inactivity or service fees. They can be used at any time while our business remains in operation.

Redemption
Gift cards may be redeemed toward the purchase of products or services available on our website. They are non-refundable and cannot be exchanged for cash except where required by law.

Lost or Stolen Cards
Please treat gift cards like cash. We are not responsible for lost, stolen, or unauthorized use of gift cards.

Balance Use
If your purchase exceeds the gift card balance, the remaining amount must be paid using another accepted payment method. Any unused balance will remain on the card for future use.

Business Closure
In the event that we permanently close our business, gift card holders will be provided with notice and a reasonable period of time to redeem any remaining balances. After this period, unredeemed balances may no longer be honored.

Compliance with Laws
These terms are intended to comply with applicable federal and state laws. Where required by law, certain provisions may be adjusted or superseded.
